City of Fitchburg Collective Bargaining Agreements

Fitchburg Public Employee Committee (PEC)


This collective bargaining agreement is pursuant to M.G.L. Ch. 32B, S. 19 as amended by the Ch. 67 Acts of 2007.
A representative of each collective bargaining unit in the City and a duly appointed retiree representative have joined together to form the PEC as provide for in M.G.L. Ch. 32B, S. 19;
Now therefore, pursuant to M.G.L. Ch. 32B, S. 19, the city and the PEC hereby agree to the following which shall govern the provisions of health insurance offered by the City to its employees. The PEC is comprised of 17 active City Unions and representation from City of Fitchburg retirees.


Civilian (Police) Dispatcher and Airport Linemen Recognition


The City hereby recognizes the Union as the exclusive representative for the purposes of collective bargaining with respect to wages, hours, and any other terms or conditions of employment for all employees certified by the Massachusetts Labor Relations Commission (MCR-4312, August 8, 1994). This contract also includes the positions of Parking Control Officer(s) and Airport Linemen as of July 1, 2003. Teamsters Union Local 170 has 15 members.


Clerical Union Recognition


The Municipal Employer recognizes the American Federation of State, County, and Municipal Employees and its appropriate affiliates, AFL-CIO as the sole and exclusive representative for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment for the following appropriate bargaining unit of employees of the City of Fitchburg:
Clerical employees determined to be members of a unit appropriate for the purpose of collective bargaining as certified by the Massachusetts Labor Relations Commission on September 28, 1970, Case No MCR-727.
Local chapter #2034 does not include school department clerical employees.

Department of Public Works (DPW) Recognition


The Municipal Employer recognizes the Massachusetts Laborers’ District Council / Local 39 as the sole and exclusive representative for the purpose of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment for the following appropriate bargaining unit of employees of the City of Fitchburg.
Certain non-professional employees of the Department of Public Works Highway, Wastewater and Sewer Division, Water Division, Parks Division and Cemetery Division, determined to be members of the Union appropriate for the purpose of collective bargaining by the Massachusetts Labor Relations Commission on April 3, 1969, Case no. MCR211. MLDC / Local 39 has a total of 96 members.

Fitchburg Association of ManAgers, Administrators and Specialty Skills (FAMASS) Group Recognitions


The City recognizes the FAMASS Group as the exclusive bargaining representative with respect to wages, hours of work and other terms and conditions of employment of all employees as outlined on attached Appendix A. Appendix A is a listing of all positions in the bargaining unit as of the date of execution of this agreement.
Total employees 40.

Fitchburg Fire Department Recognition


The City hereby recognizes the Union as the exclusive representatives for the purposes of collective bargaining with respect to wages, hours, standards of productivity and performance, and any other terms or conditions of employment for all permanent Firefighters, Lieutenants, and Captains, excluding the Chief of the Department, Deputy Chiefs, and any other employees of the Department and all other employees of the City. Throughout this agreement the terms: fire fighter(s) or employee(s) shall be intended to include all Fitchburg Fire Department personnel holding the rank of Private, Lieutenant, and Captain.
Fitchburg Permanent Fire Fighters Association I.A.F.F. Local 3128.
Total employees in this department 81.

Fitchburg Inspectors Union Recognition


The Municipal Employer recognizes the Service Employees International Union Local (SEIU) 888 (hereinafter referred to as the Union) as the sole and exclusive representative of the purpose of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment for the following appropriate bargaining units of the City of Fitchburg: Inspection Group including the Wire Inspector, Electrician, Plumbing/Mechanical Inspector,
Scale Master, Animal Control Officer, Building Inspector, Supervisor Building Maintenance, Senior Custodian(Police Station), Public Health Nurse. Total employees 19.

FITCHBURG POLICE DEPARTMENT RECOGNITION


The City hereby recognizes the Union as the exclusive representative for the purposes of collective bargaining with respect to wages, hours, standards of productivity and performance, and any other terms or conditions of employment for all permanent Patrol Officers, Sergeants and Lieutenants. Fitchburg Police Union (FPU). Total employees in this department 80.

Fitchburg Public Library Association Recognition


The Employer recognizes the Fitchburg Public Library Staff Association as the sole and exclusive bargaining agent for the purpose of establishing salaries, wages, hours and other specific conditions of employment as contained in this agreement for all employees of the Fitchburg Public Library except the Chief Librarian and Civil Service employees.

Fitchburg Wastewater Facility Recognition


The Municipal Employer recognizes the Service Employees International Union Local 888 (SEIU) referred to as the "Union" as the sole and exclusive representative for the purpose of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment for the following appropriate bargaining units of the City of Fitchburg. The Wastewater Department has 33 employees.
